Hi,
I'm new to this site and I think it would be great if there would be a "Direct Downloads" subforum. I stumble across links to horror movies at rapidshare, megaupload etc. from time to time, and I think it's a great way to download movies... So why not open an extra section here at Dead Donkey?

There's this place they like to put criminals in the uk, and i have no intention of going there.
Direct Downloads are illegal, which includes rapidshare and megaupload. Even though they won't be hosted on this site, they will be made available for direct download.
The only sites that can get away with it are those that are very dubiously for-profit run, or in some backwater country where they don't seem to care about such things. no offense to any russains out there, but .ru is one such domain.
In terms of direct downloads and rapidshare, .torrent, .nzb and other metadata hashing and smaller more copyright-free files such as subtitles and images are about the extent that can be allowed.
I've seen stuff like silent hill on rapidshare snuck into threads on some p2p sites, but if a moderator saw them i doubt they'd last. I'm pretty sure our host would object to rapidshare too.
The other problem is that rapidshare has caps on what you can download in a day from an ip, and links dry up fast. That's academic really though.

Hi, thanks for the answer. So you mean downloading Silent Hill (as an example) from rapidshare is illegal in the UK, but getting it through BitTorrent or Emule isn't? That's funny, I'm from Germany and here it's kind of the other way round. Here you get busted when you _share_ files, not when you just download them. Many people over here stopped using Emule because of that, including me. Anyway, it was just a suggestion.

its illegal in *any* country to directly link to copyrighted material. They only get away with it in russia because of lax law enforcement.
In germany, rapidsharing to copyrighted material is illegal. The admin of the site that provides the link is liable and so too is the person that posts the link, and if push comes to shove, the admin likely to be arrested and jailed for copyright infringement. You might not get busted for downloading, but I would be for allowing that stuff on my site.
Any site, german, or otherwise that provides downloads to copyrighted material on http or ftp is treading a mighty fine line. The reason the service is available is likely because no one has acted upon it in terms of anti-piracy organisations.
Emule and bit torrent posting is a different kettle of fish. The only information is a hash, the user does all the work in finding and downloading (albeit the user's client application does that). There's no assurances of existance, verification or anything like a direct link provides. Hashing has never, nor is likely to ever be proven illegal.

I know its a pisser, but anything over http or ftp that is anything other than a hash is out of the question.
We allow NZB @ hhah, which is a bit more dubious since its not hashing (a lot of sites won't allow nzb), but then you've got to find your own service that hosts them.
Some nzb sites got closed down, but i doubt anything will come of it. I've yet to hear or any ed2k or torrent site that's gone to court. Direct links there's countless that have and lost. Its a violation of the DCMA and the european copyright directive which applies to germany.
If you know any rapidshare sites, you'll probably spot a link to legal or dcma where they can recieve complaints. Site admins use this as a get out close as in "we don't know what's on the site but will remove anything if requested", several warez sites tried the same and lost in court but that's how they fight off legal warnings.
Your right about the not uploading = not a big problem for you, its because the mpaa/riaa suing people has been commercial suicide for them. They are essentially suing the same people that buy the stuff in the first place. The site admin though, that's an entirely different story, they are targeted as suppliers.

copyright laws and thier enforcement really piss me off. They seem to be so vague, or unclear that anyone with money(big business) can sue average joe citizen with 'evidence' supplied by themselves slanted just to make some profit regardless of any kind of guilt, and the accused have to prove they are innocent. Wich involves having an assload of money to pay. And even if you prove you've done nothing wrong, they can cease your computer, and maybe return it when they feel like it, or not at all.
