Hey, CM people, keep the tracker up, but only use it for people releasing their own horror movies. Be the BT site of choice for amateur filmmakers. All it would require is some sort of verification system. Say the file has to be viewed by an admin before it is posted or something. You can be the newgrounds of horror. I know I would want my stuff posted there.

The situation has sadly taken a turn for the worse. After contact with MPAA lawyers to attempt to resolve the situation the folllowing letter arrived this morning :

We appreciate your quickly responding to our Notice Letter. As you know, on December 14, 2004 we filed a suit, Columbia Pictures Industries, Inc. v. Does 1 - 10 (case number 04-cv-1192), in the Eastern District of Wisconsin. The suit asserts claims of copyright infringement against the unknown operator(s) of the Crazey Mazey tracker and torrent site. Though we have not yet named you personally as a Defendant; we intend to do so in the future. The suit ultimately seeks as relief both damages and an injunction. Under U.S. copyright law, an infringer can be liable for up to $30,000 per copyrighted work infringed, and that number increases to $150,000 if the infringement is deemed to be "willful." I wish that were true George. International law now dictates that it does which is why European countries such as Finland/Holland and France were raided.

I thought international law states that if an item is copyrighted in one country then it is automatically copyrighted in all other countries, and the law of the country in which the infringement occurred applies. AFAIK the penalty for copyright infringement in the UK is the cost of the infringing item(s), ie ?20 x no of films quoted. I could be wrong on that final point but I'm sure they would have to sue under UK law, and under Finnish, Dutch or French law in the earlier cases. America does not own the world as much as they might like to think they do.

I suppose the question now is, does running a tracker constitute a copyright infringment? It is an accessory to copyright infringement, but is it directly infringing the copyright?
Regardless, I hope everything pans out OK for all at CM's.
